The Fine Print

Yep, this is the official stuff — the terms, conditions, waivers, and policies that keep everything rolling smoothly and legally. It’s where you’ll find all the nitty-gritty details about rentals, responsibilities, and how we keep things fun and fair. Not the most thrilling read, but definitely worth a skim before you ride.

TERMS AND CONDITIONS

RENTER RESPONSIBILITIES

Renter agrees to the following terms and conditions while operating the E-Bike or using any equipment provided by Scenic Spin E-Bike Rentals, LLC (“Company”) to Renter related to Renter’s use of the E-Bike:

  1. Helmets are mandatory. 
  2. No person under the age of 16 shall be permitted to use and/or operate the E-Bike. All minor children who are at least 16 years of age but not yet 18 years of age, a parent or guardian must sign this Agreement for the minor to be able to use the E-Bike and accepts full responsibility for ensuring the minor strictly complies with the terms and conditions hereof. The parent or guardian executing this Agreement shall be fully liable for any violations of the minor child for whom they accept responsibility by signing this Agreement. All groups must have at least one (1) adult Renter travelling with them at all times while using the E-Bike.
  3. Must have a valid photo ID. 
  4. You authorize the Company to charge the credit or debit card on file used to secure the reservation online for the deposit being held and for any other fees that arise under this agreement.
  5. E-Bikes must remain within a 25-mile radius of the place of E-Bike pickup from the Company.
  6. Renter has read all safety instructions regarding the use and operating of the E-Bike that has been provided to them by the Company.
  7. Bikes must be locked when unattended and treated with care.
  8. Renter agrees to follow all New York State cycling laws. 
  9. Any damage, theft, or loss is the renter's responsibility and will be charged accordingly.
  10. Riding under the influence of drugs or alcohol is strictly prohibited.
  11. Arrival Time: Renters must arrive 20 minutes prior to the start of their reservation for safety training and instructions. The rental period begins at the time of the reservation.
  12. Cancellation/No Show Policy: Renters who do not arrive within 30 minutes following the start of their rental period will forfeit their reservation with no refund. Renters may cancel their reservation up to 24 hours prior for a full refund. No other refunds will be offered except in the sole discretion of the Company.
  13. Late Return Policy: Renters who return past the end of their reservation time are subject to a $25 late fee per bike, per hour.


LIABILITY

Renter acknowledges and assumes the inherent risks of riding an electric bicycle, which may result in bodily injury or disfigurement, disability, property damage, or death.

A signed liability waiver in the form attached hereto as Exhibit A, is required before equipment is released.


INSPECTIONS

Prior to commencing the rental, Renter and a Company staff member will inspect the bike to be rented to review the condition prior to renting, in the form attached hereto as Exhibit B, and will complete the same inspection upon the return of the E-Bike using the form attached hereto as Exhibit C. 


RENTER NAME & LIKENESS ACKNOWLEDGEMENT

Renter hereby grants an irrevocable permit, authorize, grant, and license to Company and its affiliates, successors, and assigns, and the employees, officers, directors, and agents of each and all of them (“Authorized Persons“), the rights to display, publicly perform, exhibit, transmit, broadcast, reproduce, record, photograph, digitize, modify, alter, edit, adapt, create derivative works, exploit, sell, rent, license, otherwise use, and permit others to use my name, image, likeness and all materials created by or on behalf of us that incorporate any of the foregoing  (“Materials“) in perpetuity throughout the universe in any medium or format whatsoever now existing or hereafter created without further consent from or royalty, payment, or other compensation to you. 


PAYMENTS & PAYMENT PROCESSING

Renter agrees to and will pay all amounts due to us under this Agreement via Electronic Funds Transfer (“EFT”), credit card or debit card through Company’s chosen third party payment processor, currently Booqable.com (“Booqable”). By signing this Agreement and using Company’s services, Renter agrees to be bound by Booqable’s terms of service ([insert web link]) and privacy policy ([insert web link]) and consents and authorizes Booqable to share information and payment instructions provided by Renter as necessary to process transactions and otherwise in accordance with this Agreement and the policies of Company and Booqable.   

Renter further understands and agrees that Renter is responsible for the credit card processing fees associated with processing transactions to Renter’s Booqable account as well as any other fees which may be incurred as a result of opening, operating, maintaining, or closing such an account, in addition to any which may be charged to Renter by Company. Renter will remain exclusively liable for all refunds, chargebacks, or transaction reversals (including any applicable fees imposed by Booqable) associated with Renter’s account. Renter understands and agrees that Booqable is a third-party service and that Company is not and will not store any of Renter’s payment information nor be responsible or liable in any way for acts or omissions on Booqable’s part. 

Company reserves the right to add or modify payment methods in the future. In such case, Company will notify Renter of the change and offer Renter the option to choose an alternative payment method. 


WEATHER POLICY

Unsafe weather may qualify for store credit, subject to Company’s sole discretion. No cash refunds unless otherwise agreed to by the Company. 


JURISDICTION & VENUE

Should there be any disputes regarding this Agreement or any other aspect of the relationship between Renter and Company which results in a legal or quasi-legal action being initiated, New York State laws and rules shall apply to the extent allowable. Renter irrevocably consents to  the jurisdiction and venue for any legal or quasi-legal action shall only be with a court located within Monroe County, New York

Exhibit A

RELEASE, WAIVER OF LIABILITY, AND INDEMNIFICATION

I, THE UNDERSIGNED RIDER AND/OR PARENT/GUARDIAN OF RIDER, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE SCENIC SPIN E-BIKE RENTALS, LLC (THE “COMPANY”), ITS OWNERS, EMPLOYEES, OFFICERS, AGENTS, AND AFFILIATES (THE “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, OR INJURY, INCLUDING DEATH, THAT MAY BE SUSTAINED BY ME OR MY PROPERTY OUT OF THE USE AND OPERATION OF THE E-BIKE, CHARGER, HELMET, LOCK OR ANY OTHER EQUIPMENT PROVIDED BY THE COMPANY TO ME (THE “EQUIPMENT”), WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE (THIS “RELEASE”).

I FURTHER AGREE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THAT I HEREBY IRREVOCABLY WAIVE ALL LEGAL AND EQUITABLE RIGHTS RELATING TO ALL LIABILITIES, CLAIMS, DEMANDS, ACTIONS, SUITS, DAMAGES, AND EXPENSES, INCLUDING BUT NOT LIMITED TO CLAIMS FOR COPYRIGHT OR TRADEMARK INFRINGEMENT, INFRINGEMENT OF MORAL RIGHTS, LIBEL, DEFAMATION, INVASION OF ANY RIGHTS OF PRIVACY (INCLUDING INTRUSION, FALSE LIGHT, PUBLIC DISCLOSURE OF PRIVATE FACTS, AND MISAPPROPRIATION OF NAME OR LIKENESS), VIOLATION OF RIGHTS OF PUBLICITY, PHYSICAL OR EMOTIONAL INJURY OR DISTRESS, OR ANY SIMILAR CLAIM OR CAUSE OF ACTION IN TORT, CONTRACT, OR ANY OTHER LEGAL THEORY, NOW KNOWN OR HEREAFTER KNOWN IN ANY JURISDICTION THROUGHOUT THE WORLD (THE "CLAIMS"), ARISING DIRECTLY OR INDIRECTLY FROM THE EXERCISE OF THE RIGHTS OF COMPANY AND ITS AFFILIATES, SUCCESSORS, AND ASSIGNS, AND THE EMPLOYEES, OFFICERS, DIRECTORS, AND AGENTS OF EACH AND ALL OF THEM (“AUTHORIZED PERSONS”) UNDER THIS AGREEMENT OR THE PRODUCTION, EXHIBITION, EXPLOITATION, ADVERTISING, PROMOTION, OR OTHER USE OF THE MATERIALS, AND WHETHER RESULTING IN WHOLE OR IN PART FROM THE NEGLIGENCE OF COMPANY OR ANY OTHER PERSON, AND I HEREBY COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST ANY AUTHORIZED PERSONS AND FOREVER RELEASE AND DISCHARGE THE AUTHORIZED PERSONS FROM LIABILITY UNDER SUCH CLAIMS.

I FURTHER AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY LOSS, LIABILITY, DAMAGE, OR COST, COURT COSTS AND ATTORNEY FEES, THAT MAY ARISE DUE TO MY PARTICIPATION UNDER THE RENTAL AGREEMENT SIGNED BETWEEN ME AND THE COMPANY (THE “RENTAL AGREEMENT”) OR USE OF THE EQUIPMENT. 

I acknowledge, agree and represent that I understand that riding and operating an E-Bike (the “Activity”) involves inherent risks and dangers, including serious bodily injury or death, and that I am qualified and in good health and in proper physical condition to participate in the Activity. Nevertheless, I have voluntarily chosen to participate in the Activity and assume full responsibility for all such risks, even those arising from the negligence of the Released Parties. If at any time I believe the conditions to be unsafe, I will immediately discontinue further participation in the Activity.

This release shall be binding upon me, my heirs, assigns, personal representatives, and next of kin.

ADDITIONAL LEGAL TERMS

I agree that this Release shall be governed by and interpreted in accordance with the laws of the State of New York. Any legal action or proceeding related to this Release shall be brought exclusively in Monroe County, New York.

I accept full responsibility for the Equipment rented under the Rental Agreement, whether it is used by me or loaned to another person during the rental period, as defined in the Rental Agreement.

I agree not to use the rented Equipment for racing, stunt riding, on highways, or other pathways or trails not suitable or designated for E-Bikes, or towing, or to allow it to be used in any way that violates the Rental Agreement or applicable laws. Renter shall not transport (e.g. by automobile, trailer or tow) the E-Bike other than riding it to and from the pickup location.

Exhibit B

I understand that only the undersigned is authorized to operate the E-Bike. I will not allow anyone else to ride without the prior written permission of the Company.

If this Release is signed on behalf of a minor Rider, I certify that I am the parent or legal guardian of the named minor Rider below and I have the authority to waive rights on their behalf. In the event that I am signing this Release on behalf of a minor Rider that I am not the parent or legal guardian for I agree to indemnify and hold harmless the Released Parties to the fullest extent of the law in the event any Released Parties suffer loss or damage as a result of the minor’s use or operation of the Equipment. 

IN NO EVENT SHALL THE COMPANY AND/OR ANY RELEASED PARTY BE LIABLE FOR ANY CAUSE OF ACTION, CLAIM, DAMAGE, DEMAND, EXPENSE, FINE, INVESTIGATION, LIABILITY OR PENALTY IN EXCESS OF THE AMOUNT YOU HAVE PAID TO THE COMPANY IN CONNECTION WITH THE RENTAL AGREEMENT. 

This Release along with any other written, executed, and valid agreement between the Parties, constitutes the entire agreement of the Parties, and supersede all prior oral agreements and understandings. This Release may only be modified in writing with the written consent of both Parties. This Release is intended to bind only the Parties hereto, and their successors, and may not be assigned by either Party without the express written consent of the other. 

In the event that a court of competent jurisdiction determined that any provision of this Release is invalid, all other provisions shall survive. 

Scenic Spin Privacy Policy

Effective Date: July 12, 2025

At Scenic Spin E‑Bike Rentals, LLC (“we,” “us,” or “Company”), your privacy matters to us. This policy explains what information we collect, how it’s used, and how we keep it safe—plus how it ties into our official rental terms featured in The Fine Print.

1. Information We Collect

When you book a reservation or browse our site, we may collect:

  • Personal info: Name, email address, phone number, and reservation details that help us confirm and manage your booking
  • Payment information: Processed securely through third-party providers, Booqable and Stripe. We do not store your credit card or banking details on our servers.
  • Website analytics: IP address, device type, and usage patterns—all to improve your experience and our site’s performance

2. How We Use Your Information

Your information helps us:

  • Process and confirm reservations
  • Enforce the terms in The Fine Print, including waivers, safety compliance, and liability protections
  • Communicate updates, e-bike instructions, or confirmations
  • Understand how people find and use our site for continuous improvement

3. Data Sharing & Third Parties

We never sell or rent your personal information. We share your data only as needed to:

  • Process bookings via Booqable and Stripe, under their respective terms and privacy policies. You authorize the sharing necessary to complete transactions.
  • Comply with legal obligations or enforce our rental policies, including those listed in The Fine Print

4. Your Rights

You can always:

  • Update or correct your contact info
  • Request access to the personal data we hold
  • Ask us to delete or restrict your data
  • Contact us with questions about how your data is handled
